About These Terms
These terms are an agreement between you and [EventU to confirm: registered name of the business that operates EventU], [EventU to confirm: legal form and place of registration, for example a private company registered in South Africa], registration number [EventU to confirm: CIPC registration number], which runs EventU ("EventU", "we", "us"). They apply on top of our Terms of Service. Where the two differ on organiser or vendor matters, these terms apply.
If you accept them for a business, you confirm that you are authorised to bind that business, and "you" means the business.
Your Organisation and Team
- Keep your organisation’s details accurate, including its legal name and contact details.
- You decide who joins your team and what role they have. You are responsible for what your team members and door staff do on EventU.
- We may ask for documents that show your organisation is registered and licensed for its events, and we may check them.
Getting Paid
- To publish events you add a South African bank account. We then create a Paystack subaccount for your organisation, and Paystack pays your share of each sale into that bank account.
- Paystack normally settles 2 working days after each sale. We do not hold your money, and Paystack sets its own settlement timing.
- Paystack is an independent payment provider. Its own terms and checks apply to your subaccount, and it may delay or refuse a payout under them.
- A payout can be delayed if your bank details are rejected. You can update them in your dashboard.
Fees
- EventU charges a platform fee of 3% of the price of each ticket you sell. VAT: [EventU to confirm: whether VAT is added to the platform fee, and the VAT number if registered].
- Paystack charges its own card processing fee, which we pass on at cost and never mark up. For local cards Paystack currently publishes 2,9% + R1 per transaction, with the R1 waived under R10. Other payment methods have other rates, and Paystack’s published pricing is what applies.
- Your Paystack subaccount bears both fees. They are deducted when the buyer pays, before your share reaches you.
- Buyers pay no booking fee. The price you set is the price the buyer pays.
- Our platform fee and Paystack’s fee are not returned when an order is refunded, including when you cancel an event.
- We may change our fees by giving you [EventU to confirm: notice period before a fee change] written notice. A change does not affect tickets already sold.
Your Events
- You are the supplier of your event to the people who buy tickets. You are responsible for running it lawfully and safely, and for holding every permit, licence and approval it needs.
- Your event listing must be accurate: date, times, venue, prices, age limits and anything a buyer would reasonably need to know.
- You confirm you have the rights to the names, images and text you upload, and you allow us to show them on EventU and to promote your events.
- We may refuse or remove a listing that is unlawful, misleading or puts people at risk.
Refunds, Cancellations and Disputes
- You set your refund policy. It is shown to buyers at checkout and must comply with the Consumer Protection Act, 2008. Buyers’ rights under that Act apply whatever your policy says.
- You decide refund requests under your policy and tell us which you approve. We pay approved refunds through Paystack to the buyer’s original payment method.
- If you cancel an event, every buyer gets back what they paid. Tell us straight away so we can let buyers know.
- You fund every refund, because the sale money was paid out to you. You allow us and Paystack to recover a refund from your subaccount balance or future payouts, and you will pay us any amount that cannot be recovered that way.
- If a buyer disputes a payment with their bank, Paystack may take the amount from your subaccount. We may share check-in records to help contest it, and we may pause your payouts while a dispute is open or if your dispute rate is unusually high.
Resale of Your Tickets
Where resale is available for your events, buyers can resell tickets through the EventU resale marketplace, at up to 50% above the original price. A resold ticket is reissued to the new buyer and the old QR code is cancelled, so your door scan stays accurate. You receive nothing from a resale, and you owe nothing on one. What a resale seller is paid, and how and when: [EventU to confirm: what a resale seller is paid, and how and when].
Working With Vendors
Vendors are caterers, photographers, DJs, security providers, venues and other service providers listed on EventU.
- When an organiser books a vendor, the agreement for the service is between the organiser and the vendor. EventU provides the tools to invite, quote, approve and pay, and is not a party to the service.
- A profit share agreed for payment at checkout is paid automatically in each order’s Paystack split to the vendor’s subaccount, out of the organiser’s share. A vendor without a subaccount is not paid by the split.
- A flat fee, and any amount agreed for payment after the event, is owed by the organiser to the vendor once the event is complete. EventU does not pay it out of its own funds.
- Vendors must provide the services they quote, keep their profile and documents accurate, and hold every registration and licence their service needs.
- Organisers who booked a vendor can review them, and the vendor can reply. We do not choose, edit or reorder reviews. We remove a review only if it is unlawful, and we remove its text if its author asks us to delete their personal information.
- If you link a personal calendar, we keep only the times you are busy, never the titles of your entries, so you are not double booked. A linked Google calendar also gets your EventU bookings added to it; with any other calendar you can subscribe to a feed of your bookings instead.
Catering and Food and Drink Lock-In
- You can offer buyers a food and drink choice with their ticket and link the menu to your caterer.
- Choices lock in 72 hours before the event starts unless you set another time or lock in early. At lock-in the caterer receives the final counts.
- After lock-in, choices can no longer be changed.
- The caterer is responsible for food safety and for the accuracy of dietary and allergen information. If a vendor imports a menu with our automated tool, suggested dietary tags are never applied until the vendor confirms each one.
Attendee Information and POPIA
You receive personal information about your buyers and attendees, such as names, contact details, check-in records and food choices. You may use it only to run and follow up on your event and as the Protection of Personal Information Act, 2013 allows. Ask attendees only for what your event needs, and ask for sensitive information, such as ID numbers, medical conditions or accessibility needs, only where you have a clear safety or legal reason. Send marketing only to people who opted in, through EventU’s tools, which apply their opt-outs. Keep the information secure, and tell us at privacy@eventu.co.za without delay if you suspect it has been accessed by someone who should not have it.
The EventU API and Webhooks
- API tokens belong to your organisation. Keep them secret and revoke any token you think has leaked. You are responsible for every call made with your tokens.
- We store tokens only as a one-way hash, so we cannot show you a token again after it is created.
- Use the API within the rate limits and scopes that apply to your tokens. Our developer page explains how the API works. Do not use it to get around checkout, to scrape other organisers’ data, or to resell access to it.
- Webhook deliveries are signed. Check the signature before you trust one. We retry failed deliveries and switch off a webhook after repeated failures.
- Data you receive through the API is covered by the attendee information rules above.
Ownership
We own EventU, its software and its brand. You keep ownership of your content and your attendee relationships. You allow us to host and show your content as needed to run and promote your events.
Suspension and Ending These Terms
You can stop using EventU at any time by contacting us. We may suspend or close your organisation if you break these terms, if we suspect fraud, if your events are unlawful, or if you do not fund refunds you owe. Ending these terms does not cancel refunds or fees already owed for tickets you sold.
Liability
- Our total liability to you under these terms is limited to the platform fees we earned from you in the 12 months before the claim.
- We are not liable for indirect or consequential loss, such as lost profit, or for outages at Paystack or other third parties.
- These limits do not apply to fraud, gross negligence or wilful misconduct.
- You will cover our losses from claims about your events, your content or your use of attendee information, including claims by buyers, vendors and authorities.
Changes, Governing Law and Contact
We may update these terms and will notify you of material changes before they take effect. These terms are governed by the law of the Republic of South Africa, and disputes go to [EventU to confirm: court division for disputes]. Contact us at booking@eventu.co.za. Legal notices go to [EventU to confirm: address for service of legal documents]. Our full business details are on our Business Details page.
